HIPAA Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Who Will Follow This Notice

This Notice describes the privacy practices of Apogee Surgical Arts, LLC d/b/a Formari Aesthetics and Dr. Steven Gelb, MD, FACS, together with our employees, staff, contractors, and business associates who are authorized to access protected health information ("PHI") in the course of providing care or services on our behalf.

Our Pledge Regarding Protected Health Information

Protected health information ("PHI") is information that identifies you and that relates to your past, present, or future physical or mental health, the care you receive, or payment for that care. We understand that PHI is personal, and we are committed to protecting it. We are required by law to maintain the privacy of PHI, provide you with this Notice of our legal duties and privacy practices, and follow the terms of the Notice currently in effect.

Uses and Disclosures for Treatment, Payment, and Healthcare Operations

HIPAA permits us to use and disclose PHI for purposes of treatment, payment, and healthcare operations ("TPO") without a separate written authorization.

Treatment

We may use and disclose PHI to provide, coordinate, or manage your care, including consultations and referrals to other providers involved in your treatment.

Payment

We may use and disclose PHI to bill and collect payment for services from you, an insurer, or another responsible party, including obtaining preauthorization or determining medical necessity.

Healthcare Operations

We may use and disclose PHI for operational activities such as quality assessment, staff training, credentialing, accreditation, business management, and general administration.

Appointment Reminders and Patient Communications

We may contact you to remind you of upcoming appointments or to follow up after a visit, by phone, voicemail, text message, email, or postal mail using the contact information you provide.

Individuals Involved in Your Care

Unless you object, we may share relevant PHI with a family member, friend, or other person you identify as involved in your care or in payment for your care.

Emergency Situations

We may use or disclose PHI to treat you in an emergency or to notify a family member or personal representative of your location, general condition, or death.

Health-Related Benefits and Services

We may contact you about treatment alternatives or other health-related products and services that may interest you, consistent with HIPAA.

Uses and Disclosures Required by Law

We will use or disclose PHI when required to do so by federal, state, or local law.

Public Health and Communicable Disease Disclosures

We may disclose PHI for public health activities, including preventing or controlling disease, reporting births, deaths, or reactions to medications, and notifying persons who may have been exposed to a communicable disease.

Health Oversight Activities

We may disclose PHI to health oversight agencies for activities authorized by law, including audits, investigations, inspections, and licensure actions.

Abuse, Neglect, or Domestic Violence

We may disclose PHI to a government authority authorized to receive reports of abuse, neglect, or domestic violence.

Food and Drug Administration

We may disclose PHI to a person or company subject to FDA jurisdiction for activities such as adverse event reporting, product tracking, or product recalls.

Lawsuits and Disputes

We may disclose PHI in response to a court or administrative order, subpoena, discovery request, or other lawful process, subject to applicable safeguards.

Law Enforcement

We may disclose PHI for law enforcement purposes as permitted by law, including in response to a court order, warrant, or grand jury subpoena, and to identify or locate a suspect, fugitive, witness, or missing person.

Coroners, Medical Examiners, Funeral Directors, and Organ Donation

We may disclose PHI to a coroner, medical examiner, or funeral director as necessary to carry out their duties, and to organizations that handle organ, eye, or tissue donation.

Research

Under limited circumstances and with appropriate review and authorization, we may use and disclose PHI for research purposes.

Serious Threats to Health or Safety

We may use and disclose PHI when necessary to prevent a serious threat to your health and safety or the health and safety of the public or another person.

Workers’ Compensation

We may disclose PHI as authorized by, and to the extent necessary to comply with, workers’ compensation laws and similar programs.

Uses and Disclosures Requiring Written Authorization

Other uses and disclosures of PHI not described in this Notice — including most uses and disclosures of psychotherapy notes, marketing communications, and the sale of PHI — will be made only with your written authorization. You may revoke an authorization in writing at any time, except to the extent we have already acted in reliance on it.

Your Rights Regarding Protected Health Information

Right to Inspect and Copy

You have the right to inspect and request a copy of PHI maintained in your designated record set, subject to limited exceptions.

Right to Request an Amendment

You may request that we amend PHI you believe is incorrect or incomplete. We may deny the request in certain circumstances and will provide a written explanation.

Right to Request Restrictions

You may request restrictions on how we use or disclose PHI for treatment, payment, or healthcare operations. We are not required to agree, except for certain disclosures to a health plan when you have paid in full out of pocket.

Right to Confidential Communications

You may request that we communicate with you about medical matters in a specific way or at a specific location.

Right to an Accounting of Disclosures

You may request an accounting of certain disclosures we have made of your PHI.

Right to a Paper Copy of This Notice

You have the right to receive a paper copy of this Notice on request, even if you have agreed to receive it electronically.

Right to Be Notified of Certain Breaches

You have the right to be notified following a breach of unsecured PHI as required by applicable law.

Changes to This Notice

We reserve the right to change this Notice and to make the revised Notice effective for PHI we already have about you as well as any information we receive in the future. We will post the current Notice in our office and on our website.

Complaints

If you believe your privacy rights have been violated, you may file a complaint with our Privacy Officer using the contact information below or with the U.S. Department of Health and Human Services, Office for Civil Rights. You will not be penalized or retaliated against for filing a complaint.
