These Terms and Conditions (“Terms”) govern your use of the website at https://formariaesthetics.com and the SMS messaging program operated by Apogee Surgical Arts, LLC, a Florida limited liability company, doing business as Formari Aesthetics (“Formari Aesthetics,” “we,” “us,” “our”). By accessing or using the website or SMS program, you agree to be bound by these Terms. If you do not agree, please do not use the website or program.

Content on this website is provided for general informational and educational purposes only. It is not medical advice and is not intended to diagnose, treat, cure, or prevent any condition. No Doctor-Patient Relationship

Use of the website, including submitting a request a consultation form or other website forms, does not create a doctor-patient relationship. A doctor-patient relationship is established only after an in-person evaluation and acceptance of care by Dr. Steven Gelb or another credentialed clinician at the practice. Protected health information created during care is governed by our HIPAA Notice of Privacy Practices.

Emergencies

This website is not designed for medical emergencies. If you believe you are experiencing a medical emergency, call 911 or go to the nearest emergency department immediately. Do not rely on the website, email, or contact forms for urgent care.

Third-party financing options, when offered, are provided by independent lenders subject to their own terms; Apogee Surgical Arts, LLC d/b/a Formari Aesthetics is not the lender and does not control credit approval decisions.

SMS Messaging Program Terms

SMS Program Description. Apogee Surgical Arts, LLC d/b/a Formari Aesthetics operates an SMS messaging program for patients and prospective patients. The program supports two types of messages: (a) marketing messages, including procedure education, practice updates, consultation availability, and service information; and (b) transactional messages, including consultation follow-up, appointment reminders, scheduling updates, pre-operative instructions, post-operative instructions, and care coordination messages.

Eligibility. You must be at least 18 years of age, or have the consent of a parent or legal guardian, to opt in to the SMS program operated by Apogee Surgical Arts, LLC d/b/a Formari Aesthetics.

Opt-In. You may opt in by checking the applicable consent box on website forms at https://formariaesthetics.com/become-a-patient or https://formariaesthetics.com/contact-us. Marketing and transactional consent are collected separately and are each optional. Consent to receive SMS messages is never a condition of purchase or service.

Opt-Out. You may opt out at any time by replying STOP, END, QUIT, CANCEL, or UNSUBSCRIBE to any message. After opting out, you may receive one final confirmation message. To opt back in, reply START or contact us directly.

Message Frequency. Marketing messages are approximately 2 to 4 messages per month. Transactional messages are approximately 2 to 8 messages per month, depending on your inquiry, appointment activity, and care coordination needs.

Message and Data Rates. Msg & data rates may apply. Apogee Surgical Arts, LLC d/b/a Formari Aesthetics is not responsible for charges from your wireless carrier related to receiving SMS messages. Check with your carrier for details about your message and data plan.

Supported Carriers. Supported carriers may include AT&T, T-Mobile, Verizon, U.S. Cellular, Boost, MetroPCS, Cricket, and other participating carriers.

Carrier Liability Disclaimer. Wireless carriers are not liable for delayed or undelivered SMS messages. Apogee Surgical Arts, LLC d/b/a Formari Aesthetics is not responsible for disruptions in SMS service caused by carrier or third-party network issues.

Privacy. Your use of the SMS program is also governed by our Privacy Policy. We do not share, sell, rent, or transfer your mobile number or SMS opt-in data to third parties or affiliates for their marketing purposes.

Limitation of Liability

To the fullest extent permitted by law, Apogee Surgical Arts, LLC d/b/a Formari Aesthetics, and its physicians, staff, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the website, the SMS program, or reliance on their content. The website and its content are provided on an “as is” and “as available” basis without warranties of any kind, express or implied.

Indemnification

You agree to defend, indemnify, and hold harmless Apogee Surgical Arts, LLC d/b/a Formari Aesthetics, and its officers, employees, contractors, and affiliates from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your use of the website or your violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida.
